The Air Force report: the DoD letter and Grusch's account

David Grusch

Weight: Substantial

First version
Nov 1, 2023 · In a letter to Rep. Burchett, published in May 2026 in a FOIA release connected to Grusch's lawsuit, the DoD writes that no one from the Air Force ever filed a report with its intelligence oversight office (the Intelligence Oversight Directorate) and that the Air Force later reported that the information had been properly coordinated, with no unauthorized disclosure. DoD, FOIA release of May 18, 2026 linked to case 1:26-cv-00607, with the letter to Rep. Burchett of November 1, 2023
Second version
May 5, 2026 · Grusch claims that after his statements of June 2023 the Department of the Air Force filed a report against him for unauthorized disclosure under the Espionage Act, which was dismissed thanks to the prepublication authorization. Stranger than Fiction, summary of the interview on Judicial Watch's “On Watch” (May 5, 2026)
Analysis
The two versions coincide on the outcome (no unauthorized disclosure, thanks to prior coordination) but diverge on whether a formal report was filed. The letter rules out only a report to the IOD: a review started in another office, or a difference in terminology between an internal check and a “report,” would make the two accounts compatible. Grusch's version is known only from the summary of a favorable blog, without verification of the audio, and no public document confirms the reference to the Espionage Act.
